CONVEYANCING TIP (1): ARE PURCHASER’S SOLICITORS OR VENDOR’S SOLICITORS TO PREPARE SUB-SALE S&P AGREEMENT?

Many lawyers will say that it is conveyancing practice that Purchaser’s Solicitors draft the SPA to be forwarded to the Vendor’s Solicitors for perusal and approval.

However, every few lawyers know that it is actually the Vendor’s Solicitors which should draft the SPA. Where is this found?

Rule 16.01(7) of Rules & Rulings of the Bar Council – The Vendor’s Solicitor shall prepare and supply the SPA unless otherwise mutually agreed with the purchaser.
